Barca have faced a series of legal troubles over the transfer and the fee, which saw Neymar complete the switch.
Brazilian investment group DIS, which owned 40 percent of the forward's transfer rights, alleges it received less money that it was entitled to and subsequently launched a complaint.
Barca thought they had brought the affair to a close but Spain's public prosecutor has called for Neymar to be sent to prison for two years for his part in the case.
However, Neymar is likely to be handed a hefty fine for his part with any Spanish prison sentence under two years suspended on first offence.
The same has occurred with club mates Javier Mascherano and Lionel Messi in recent times.
Judge Jose Perals also called for ex-Barca president Sandro Rosell to be handed a five-year sentence and Barca be slapped with a €8.4m fine.
Rosell resigned as president in 2014 for his role in the affair and testified in court alongside Neymar and his father.
Barca struck a deal with prosecutors to settle a separate case earlier this year, paying a €5.5 million fine and avoided trial on charges of tax evasion over the transfer.
